In 2007 the House of Lords decided that section 75 has no territorial limitations. The ruling means that consumers are also protected when making purchases abroad. Timeshare was sold all around the world, mis-selling, unfortunately also has no borders.
Fortunately, if you paid for your timeshare or fractional ownership by credit card or linked finance, your purchase is protected under the 1974 consumer credit act, no matter which country you purchased in.
It’s important to remember that only regulated loans are protected. Loans provided by american timeshare resorts and loans provided by Club la costa in turkey are not regulated. Loans supplied outside of the UK can’t be credit check searched. An assessment of affordability doesn’t take place and does not show on your credit report. Hence is legally unenforceable unless the lender decides to pursue you through the courts.
In our experience, Timeshare resorts in the USA and Club La Costa in Turkey will take credit card deposits. As such, the payments you have made are protected under section 75. Get in contact with us if you feel that you have been mis-sold.
